SUMMARY:A Michigan Green Amendment: A New Tool for Environmental Protection & Justice
DESCRIPTION:The people of Michigan have rights to free speech and religion\, the right to bear arms and to freely assemble\, but we do not have the right to clean water and air\, a stable climate and healthy environments. The failure to constitutionally recognize and protect environmental rights means that government officials are often free to disregard water\, air\, climate and environmental protection in favor of other political or economic priorities and there is little recourse for impacted communities. \nLeader Maya van Rossum and her organization\, Green Amendments For The Generations\, are working to transform this legal paradigm by inspiring support for Green Amendments\, i.e. constitutional amendments added to the Bill of Rights section of every state constitution\, and ultimately the federal constitution\, which recognize and protect the inalienable rights of all people to pure water\, clean air\, a stable climate and healthy environments—regardless of race\, ethnicity or socioeconomic status and including future generations. And for decades\, while achieving some important successes in environmental protection\, overall the health of our environment for present and future generations has continued to degrade from a growing number of sources. The truth is\, our laws are designed to accommodate pollution as much as\, perhaps even more than\, to prevent it. As a result people feel powerless when it comes to preserving the quality of their water\, air\, public parks\, and natural spaces. But there is a solution for achieving better\, and much needed\, protection of our environment: bypass the laws and turn to the ultimate authority—our state and federal constitutions. \nOn February 9\, 2021 Representative Lekanoff introduced HJR 4205\, an amendment to the state constitution\, enshrining the rights of all Washingtonians to clean water and air\, a stable climate and healthy environment.
