The Pennsylvania Green Amendment is used as grounds for lawsuit challenging the “deemed approval” of a data center in Muncy Township, PA.
If victorious, this litigation will be a game changer for the power dynamics between developers and local government.
On September 25, 2026, Green Amendments For The Generations and Muncy Township, joined by neighbors and residents, challenged sections of the state Municipalities Planning Code as unconstitutional on the grounds of PA Green Amendment Environmental Rights, property rights & due process. The case, filed in the Commonwealth Court of Pennsylvania, argues that the asserted ‘Deemed Approval’ of the Danko Data Center violates environmental rights and due process protections. If victorious, this case could have far-reaching ramifications for data centers and development projects statewide who have long enjoyed the benefits of ‘Deemed Approval’ as a way to advance.

October 8 is DAF Day!
DAF Day is a national day of giving with donor advised funds. A DAF is a charitable savings account (like a 401k for giving). It’s already a powerful tool for any donor to accelerate their giving, but it has even greater potential when we all DAF together. Check out Chariot’s Get A DAF Guide for more information on DAFs.
Help Green Amendments For The Generations make DAF Day 2026 a powerful show of strength through generosity by making DAF Donation!
Your gift will help us to Grow The Green Amendment Forest, securing a legacy of constitutional environmental rights protection for future generations yet to come. Learn more about our campaign here.
National News: A U.S. Federal Court has just reaffirmed that there is no right to clean water in the U.S. Constitution.
In knocking down the argument that there is a right to clean water pursuant to the U.S. constitution, the federal court said that the invasion of our bodies by dangerous toxins allowed to advance as the result of government action is different than sexual assault or forced surgical examination imposed by government officials.
Is it though?
Should the U.S. constitution seriously provide no clean water right or remedy?
Regardless, those in our Green Amendment movement know that a near term and accessible pathway to constitutional recognition and protection of environmental rights can be had through our state-by-state Green Amendment movement.
Read Maya’s op ed on the new federal decision, Sterling v. City of Jackson, and please share the post on your social media so we can help spread the word and grow our movement, in your state and everywhere.

Green Amendments Setting Legal Precedent

We’ve been adding some new writeups about precedent-setting legal outcomes when it comes to Green Amendment environmental rights.
We recently added this one about a PA case that demonstrates how courts can show respect for environmental rights and other constitutional freedoms.
You can see all of our legal writeups at forthegenerations.org/resources/legal-resources/.
Colorado BYO Community Picnic
On September 29, our Colorado Right To A Healthy Environment Coalition is planned a beautiful community event by the Dolores River in Montezuma County, full of live music, family activities, and environmental education.
